What changed in California eviction law

  • More time for tenants to respond. Since January 1, 2025, a tenant has 10 court days (not 5) to respond to an eviction lawsuit, which adds roughly a week to most cases.
  • Higher threshold in unincorporated Los Angeles County. Since spring 2026, a landlord in unincorporated areas generally cannot evict for nonpayment unless the tenant owes more than two months of HUD fair market rent. The City of Los Angeles threshold remains one month.
  • Stricter rules for owner move in and remodel terminations under the Tenant Protection Act, in effect since April 1, 2024.
  • New for 2026: landlords must provide a working stove and refrigerator in most new or renewed leases, and tenants whose Social Security benefits are delayed have a new defense in nonpayment cases.
